TERMS AND CONDITIONS

The Suite Sojourn LLC specializes in designing a travel experience that is seamless and stress free allowing you to make the most of your time and to create unforgettable memories. We deliver this unique experience through our cooperation with luxury hotels, resorts, and villas, aimed at providing you with a premium level of service for all kinds of Travelers. These Terms and Conditions (“Terms and Conditions”) are legally binding and govern the relationship between SS/The Suite Sojourn, LLC (“The Suite Sojourn, LLC/ The Suite Sojourn” and/or “us/our”) and you, the purchaser and/or traveler (collectively known as “Traveler” or “Passenger” or “You/Your”). The term “you” “traveler” refers to the traveler making a booking with us and all members of their group. The Suite Sojourn, LLC, is an independent contractor and independent affiliate.

CONTRACT

  • By planning travel with The Suite Sojourn, LLC, you agree to be bound by these terms and acknowledge that The Suite Sojourn, LLC acts solely as a booking agent for disclosed principal supplier tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and other services (“Supplier(s)”) and is not the source or provider of the travel services. These terms include warranties and disclaimers and exclusions of liability and may restrict your rights and remedies and provide protection to The Suite Sojourn, LLC. Parents/Guardians are required to agree to and execute this agreement on behalf of any/all or their minor children (under age 18) who are participating in a trip. Before making a booking with us you must ensure that you have read and understood these Terms and Conditions (raising any questions you may have with us). Please be aware that these terms and conditions contain waivers of liability as well as waiver of class action and venue selection and notice clauses. By asking us to confirm your booking you are accepting all of the Terms and Conditions described below and acknowledging that you have read the Terms of this contract and agree with it.
  • These Terms and Conditions govern the relationship between The Suite Sojourn LLC and you, the Traveler. These terms restrict your rights and remedies and provide protection to The Suite Sojourn LLC, including warranty disclaimers and liability exclusions. By using The Suite Sojourn services and this website you acknowledge and agree (a) this is a fair balance because this website is accessible by you conveniently and at no charge to access the website; and (b) if you do not agree or do not accept these Terms and Conditions, you can easily choose to not use this website or its services. So, if anything is in these Terms and Conditions, including warranty disclaimers and liability exclusions, that you disagree with or are not willing to be bound by, or if something is missing from these Terms and Conditions that you consider essential, then you must not use this website.
  • By accessing, using or obtaining any content, products, or services through our offices or through our website, you, the purchaser) agree to be legally bound by these terms. As such, all travel arrangements made are subject to the following terms and conditions. If you do not accept all of these terms, then please do not use our services or this website. IF THERE IS ANY PART OF THESE TERMS AND CONDITIONS YOU DO NOT AGREE WITH, PLEASE DO NOT USE THIS WEBSITE OR ANY SERVICES. No alterations to these terms and conditions may be made by any employee of The Suite Sojourn, advisor, representative or agent, unless in writing by an authorized officer of The Suite Sojourn.
  • If you are making a booking as a group, the leader of the group is responsible for sharing these Terms and Conditions with all members of the group and is financially responsible for the booking. We will not be liable for a group leader’s failure to share these Terms with all travelers in their group.

 

VIOLATIONS BY YOU

You agree that any violation of any such Terms and Conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, and (c) your being denied access to the applicable travel related product or service.

 

CHANGES TO THESE TERMS AND CONDITIONS

The Suite Sojourn, LLC, reserves the right, in our sole discretion, to change these Terms and Conditions at any time. Updated versions of the terms and conditions will be posted here on this website and are effective immediately on posting. If we make material changes, we will notify you. Please check frequently, especially before you make a booking, to see if these Terms and Conditions changed. Your continued use of our services including continuing to use or maintain any bookings after any changes to the Terms and Conditions constitutes your consent to the changes.

COVID 19 RELEASE OF LIABILITY

By booking a tour at this time, you acknowledge the highly contagious nature of COVID-19 and any other future epidemics / pandemics and voluntarily assume the risk for yourself and any minors traveling with you, that you or they may be exposed to or infected by COVID-19 by traveling and that such exposure or infection may result in personal injury, illness, permanent disability, and death even if such injuries or losses occur in a manner that is not foreseeable at the time you book your tour. You acknowledge that exposure to such viruses or disease is an inherent risk of traveling, which cannot be controlled or eliminated by The Suite Sojourn, LLC.

You acknowledge that due to the uncertainty of travel at this time, your tour may be postponed or cancelled, or changes may be made to itineraries due to closures of certain sites or activities, for which there may be no refund. You may also be required to quarantine if you test positive at any point on a tour. Some locations may require you to have a vaccination.  You are responsible for understanding these requirements and must not rely on The Suite Sojourn, LLC, to provide these details. You understand that you may become sick before, during, or after the tour and may not be able to travel and such cancellation or interruption will be subject to our cancellation terms below, for which The Suite Sojourn, and its host agency will not be liable.

You agree that due to uncertainty caused by COVID 19, The Suite Sojourn LLC has strongly encouraged the purchase of travel protection coverage including cancel for any reason coverage if and when available, and that should you fail to purchase travel protection coverage, The Suite Sojourn LLC shall not be liable to any losses howsoever arising. The Suite Sojourn LLC shall not be liable for any COIVD losses not covered by your selected travel protection coverage.

You, for yourself, and any minors traveling with you, and on behalf of your and their heirs, assigns, personal representatives and next of kin (The Releasors), HEREBY RELEASE, AND HOLD HARMLESS The Suite Sojourn LLC, its members, officers, agents, and/or employees, suppliers, and other tour members (RELEASEES), of from and against any and all claims, damages, demands, losses, and liability arising out of or related in any way, in whole or in part  to any POSTPONEMENT, CANCELLATION, CHANGES, INJURY, DISABILITY, DEATH OR ANY OTHER LOSS you may suffer due to exposure, infection, spread, closure, and travel restrictions related to COVID- 19, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

BOOKING / PAYMENT

When you are ready to start your next travel adventure simply fill out our intake form on our website where you will be redirected to a calendar to select a time to connect with one of our experts who can assist you in booking you own personalized luxury travel experience. Your booking will be confirmed on receipt of the completed registration form and non-refundable, and non-transferable deposit. After booking you will receive your itinerary, an invoice with payment information, and other important travel information. This invoice is subject to change until you receive confirmation that your travel is booked.  Some suppliers will require a larger or payment in full to hold your booking. Traveler will be notified if a larger deposit is required. Deposits are NON-REFUNDABLE, unless stated otherwise in the terms and conditions of the Supplier.

Upon booking, we will provide you with instructions of payments and all due dates.  You must make all payments in full and on time.  If you are booking within 90 days of the departure date, full payment will be due at the time of booking confirmation unless otherwise stated by The Suite Sojourn or its suppliers. If full payment is not received 90 days prior to the departure date, we reserve the right to cancel your travel and apply the cancellation charges set out in the cancellation section below. Failure to make a payment may result in the cancellation of your travel.  In such a case this would be considered a cancellation by you and the cancellation terms and fees as described below would be in effect.

Once payment for your trip is processed, you will receive i) a receipt and ii) travel documents.  Please review documents carefully and promptly as we will not be responsible for any errors. It is your responsibility to review all travel documentation and alert us as soon as possible with any corrections.

FEE SCHEDULE

The fees that we charge are outlined as follows and we reserve the right to update / make changes to our fee schedule without further notice. These fees as outlined below are independent of the fees the Suppliers charge:

Planning fees: 

Consistent with the luxury travel industry business practices, The Suite Sojourn charges an upfront, non-refundable, and non-transferable consultation, research, concierge and proposal fee for our services. These services include but are not limited to: ocean, river and expedition cruises; hotel research, destination research and consultation, and proposal fee for fully tailored trips, villa searches, yachts, and more.

  • GENERAL GUIDELINES: Each client and trip is unique; therefore, it’s not possible to provide a comprehensive list of fees for every situation. Below are general guidelines for hiring us. Please note that The Suite Sojourn™ reserves the right to change its services and fees at any time without prior notice. This will not affect yearly fees during the term of the validity. 
  • SERVICE / PLANNING FEES: Fees apply to the travel planning of your upcoming trip, including destination(s) you request or ones we propose at your request. The fees are in USD and are non-refundable, non-transferable, or for future credit and must be paid 100% in full prior to any work is commenced, including cancellation of your room/trip, or not booking. All requests must be in writing via email and via client intake form for new clients / new trips.
  • All fees charged for services by The Suite Sojourn, LLC are non-refundable. For all other partners involved in your trip (hotels, guides, cruise lines, etc.), you are responsible to adhere to their individual cancellation policies which we outline in our quotes. We highly suggest protecting your investment with travel insurance to help protect you from the unexpected. The Suite Sojourn, LLC  reserves the right to modify these fees at any time.
  • Service fees are non-refundable and non-transferable to another trip, destination, or for future credit. These fees apply whether or not you decide to book the trip / Hotel / Villa / Yacht / Private Jet / Airfare, etc. or any other service solicited.
  • FULL PAYMENT REQUIREMENT: Full payment of the fees is required before The Suite Sojourn™ begins any work, including research or recommendations. No work will commence until full payment is received.
  • CREDIT CARD PROCESSING FEE: A 5% credit card processing fee will be applied to all transactions in addition to the listed fees. You can of course direct deposit us the exact amount of fees. Please ask us for our banking details and we will be pleased to provide this to you. You will be responsible for any charges your bank imposes.
  • DESTINATION CHANGES: If you change your destination after research has begun , and / or options are presented or work has begun, The Suite Sojourn™ reserves the right to charge an additional fee for the new destination.
  • WEEKEND AND AFTER-HOURS REQUESTS: Extra fees will apply for weekend and after-hours requests. To avoid these extra $100 fees, contact us Monday through Friday from 9:00 AM to 6:00 PM EST via email. If it’s incredibly urgent, please write URGENT in your Application and we will get back to you as soon as possible.

HOTEL BOOKING ONLY (no research)

INCLUSIONS:

    • 1 Choice you know the hotel to book, the dates to book and the room category to book
    • Collecting pricing details (Room Cost, Taxes/Fees)
    • Looking for and comparing promotions
    • Handling the booking logistics
    • Adding our exclusive amenities
    • VIPing you with the hotel making sure the team has your details in advance, for example, allergies, pillow preferences, bedding preferences for the kids, asking for anything special in advance, etc.
    • This is solely a booking service if you have questions on room categories or additional questions, then Hotel + Research option is best fit for you.

WHAT’S NOT INCLUDED IN HOTEL BOOKINGS (additional concierge fees apply):

    • Airport transfers or coordination of airport transfers should they be on the rare occasion be included in your hotel price
    • Activities
    • Personal/Exec assistant tasks like booking restaurant reservations, spa reservations, hair appointments, babysitters, etc.
    • Extreme changes to scope of work
    • Answering questions on what room categories would be best fit, what hotel / resort / destination

FEES:

    • $0: So as long as you tell us what hotel to book, check in / check out dates, the room category, any special requests (such as connecting rooms) and names of all the travelers, there is no fee involved
    • Additional fees apply:
      • Last Minute booking (within 45 days): $75 per reservation, per room
      • Cancel / Change (all requests must be in writing via email): $50 per reservation
      • Group booking: 4+ Rooms are $50 per room
      • Changing room / suite / villa categories: Additional fees apply

HOTEL PLUS (Destination Consultation, Hotel Options and Concierge fees)

INCLUSIONS:

    • Collecting pricing details and promotions for upto 3 different hotels for the same dates per destination and presenting them to you
    • Booking the property of your choice
    • Attaching our exclusive amenities – usually $100 resort credit, free breakfast, and room upgrades, if available
    • VIPing you with the hotel – making sure the team has your details in advance, for example allergies, pillow preferences, bedding preferences for the kids, asking for anything special in advance, etc.
    • WHAT’S NOT INCLUDED IN HOTEL BOOKINGS (additional concierge fees apply):
      • Airport transfers
      • Activities
      • Personal/Exec assistant tasks like booking restaurant reservations, spa reservations, hair appointments, babysitters, etc.
      • Extreme changes to scope of work

DESTINATION CONSULTATION & HOTEL OPTIONS & CONCIERGE FEES

FEES:

    • USD $300 fee will apply for up to 3 hotel proposals for same dates per destination
    • Last – minute booking (within 45 days): $75 per reservation
    • Cancel/change (all requests must be in writing via email): $50 per reservation
    • Group Booking: 4+ rooms at $50 per room
    • Changing room / suite / villa categories: Additional fees apply
    • Concierge fees apply – see below for concierge requests

FULLY TAILORED TRIP: 

Your request looks a little like this: “We are going on a Honeymoon and we would like to perhaps go on a Safari and would like to end our trip in the Seychelles”

INCLUSIONS:

    • Researching availability and reserving all accommodations: Hotels, Villas, Yachts or Catamaran Charters
    • Research and advice on destinations
    • Assistance with current travel protocols
    • Presenting ONE customized tailored itinerary with 3 rounds of editing
    • Discussing strategy around booking terms, insurance, etc.
    • Booking the entire itinerary on your behalf and adding in our Virtuoso & Preferred Partner amenities, when applicable
    • Final itinerary in app format along with any relevant guides, restaurant recommendations, or destination info
    • Pricing travel insurance with our preferred provider
    • VIPing you with your hotels prior to travel
    • Assurance you will gain from working with a professional Travel Advisor with trusted partners around the world. On ground 24/7 Travel support and accessibility before, during and after your trip
    • Collecting your feedback post trip so we can apply those notes to future trips

What is NOT included in full trip bookings:

    • International air bookings (see below for air booking fees)
    • Personal/Exec assistant tasks like booking restaurant reservations, spa reservations, hair appointments, babysitters, etc. (see below for concierge fees)
    • Booking hotels with points
    • Rental car bookings – we can make recommendations but we find it’s always less hassle for you to book this directly so there is a direct line of communication between you and the rental company when you are picking up/dropping off
    • Large group bookings – if you are planning a corporate retreat or large get together we will build a custom fee usually based on the number of people
    • Extreme changes to our agreed scope of work – for example, you decide on France as your destination and after we complete our proposal, you change to Germany; or you decide you’d like to do a small luxury cruise and after we present a full proposal you decide you’d rather charter a yacht.

CUSTOM ITINERARY & TRIP MANAGEMENT FEE

    • Full Trip Planning includes our full 5 phase travel planning process – Discover, Design, Connect/Book, Experience, and Share. This service begins with a complimentary consultation call where we learn more about your trip vision and includes the following:
    • This service begins with a complimentary consultation call where we learn more about your trip vision.
    • This fee is our commitment to each other that we are going to devote the necessary time to design your trip and confirms you are ready to move forward.
    • This fee covers one itinerary proposal with 3 rounds of editing and all the nuts and bolts of a complete trip.
    • If we feel the request is mutually beneficial for our service, we charge a $800 non – refundable, non-transferable initiation fee for 1-7 days of travel for upto 5 travelers.

Additional professional fees apply:

    • Each additional partial or full week: Additional $600
    • Each person over 5 travelers: Additional $100/person/week thereafter, For example – a 12 day trip for a family of 5 equates to an $1,400 fee total
    • Last-minute booking fee: 50% for trip requests within 45 days of travel OR 90 days of holiday travel
    • NOTE: any trip requested and booked within 45 days of travel will also incur an additional 50% late fee. Exceptionally, any requests for “Festive Travel” (Dec 18 – Jan 4) will incur the late fee beginning on October is of the same year (assuming there is availability, and we have the capacity to take on more Festive trips)
    • Cancellation (all requests must be in writing via email): $100 per person
    • Additional fees apply for adjustments to travel dates after the itinerary has been finalized. For customized tours, we only work on trips where we plan and execute the entire trip including all hotels. If a client wants to use points for a hotel at the beginning or end of a cruise, we will consider this on a case-by-case basis.

 

VILLA SEARCH

We maintain great relationships with professional villa management companies around the world and are happy to book this type of travel for our clients.

INCLUSIONS:

    • Working with multiple partners to pull suitable options that have been vetted professionally
    • Narrowing down to present you with the options we feel are most suited to your preferences and budget
    • Booking the villa of your choice
    • Introducing you to the house concierge (if applicable) to plan your activities directly

FEES:

      • If you are looking for a villa as part of a larger trip: $800
      • Villa Sourcing / Management Fee: Coordinate everyone’s arrival / departure information/ names, introduce to villa team; $400. This does NOT include a full itinerary planning.
      • Late fees apply
      • Additional fees apply for adjustments after a booking has been finalized.

CRUISE MANAGEMENT

Booking a cruise can be difficult to handle on your own, even for experienced cruisers. Navigating the complexities of cruise fares can be daunting, but we’re here to assist you in unraveling the intricacies.

INCLUSIONS:

    • In addition to our knowledge, close partnerships with the top luxury cruise lines, and planning skills, you will also receive Virtuoso Voyage or other comparable benefits on many cruise itineraries.
    • Once we’ve pinpointed the ideal itinerary for you, we’ll take care of every aspect of your booking process, from securing the deposit to handling the final payment. With the current extended hold times for cruise lines, our service spares you the inconvenience of waiting on hold.

 

CONCIERGE SERVICES

When you book a fully tailored trip, in some cases, our B2B partners on the ground will make restaurant reservations. In those cases we will not charge this additional fee but this is generally the exception not the rule.

    • Most of our clients will book restaurants, spa treatments, hair appointments, babysitting, etc. directly or have their personal or executive assistants work on these tasks.
    • We work well with EAs and are happy to pass along the needed info to facilitate. We find it is always better for you or your assistants to book these so that you have the ability to change quickly/on the fly while traveling.

CRUISE MANAGEMENT FEES:

    • If there’s one thing we’ve learned in this business, it’s that trip management is often a much more significant part of a trip than the planning itself.
    • $600 Cruise Consultation and Management Fee
    • If you have already selected the cruise line and have a general idea of your destination and travel dates, fees may be reduced.

 

 

 

 

 

CONCIERGE FEES:

    • If you’d prefer for us to book these services – each service will incur a $50 concierge fee
      • For Example: 2 restaurant reservations, 1 spa treatment, and 1 hair appointment would be an additional $200 fee).
    • Additional fees apply for adjustments after a booking has been finalized.
    • Late fees apply

 

AIR TRAVEL

FEES: 

  • The Air Desk charges $100 per ticket for international Tickets or $75 per ticket for domestic tickets, per person in addition to the cost of airfare. For Commercial: we only book Business and first class.
  • If you are interested in flying private – we handle that directly and your private air booking would be covered by your full trip booking fee, $800 in addition to the cost of charter.
  • Unless otherwise noted, it is the Travelers’ responsibility to make appropriate air arrangements, as well as other transportation(s) to and from the destination where the travel booking originates and returns, unless you have booked a fully fitted trip including VIP assist, meet and greet upon disembarkation, and chauffeur services. The Suite Sojourn LLC does offer private jet bookings and will occasionally assist Travelers in booking international business or first-class trips subject to a booking fee. It is important that the names provided to secure reservations must match travelers’ passport. Middle names are not required to appear on airline tickets. Date of birth and complete passport details are required. Any minor name corrections advised after airline tickets have been issued will incur fees. Not all name corrections will be permitted by airlines and may require the purchase of a new ticket. Travelers voluntarily assume full and sole responsibility for any and all risks and/or costs involved with failure to report any errors and/or omissions to documentation. You must not make any air reservation until you receive confirmation of your booking. Your contract for airfare is with the carrier and subject to its terms and we will not be liable for any change fees or cancellation fees or other additional cost you incur with the air carrier. The Suite Sojourn, LLC shall not assume any responsibility for any air and/or ground schedule changes.
  • Your airline ticket is a contract between you and the air carrier, even if you purchase through SS/The Suite Sojourn. If you purchase air travel through SS/The Suite Sojourn, you acknowledge and agree that SS/The Suite Sojourn does not have the right to control the operations of independent airlines, and agree that SS/The Suite Sojourn is not liable for any personal injury, property damage related to your purchase of air tickets or air travel, including, but not limited to any act, error, omission, injury, loss, accident, or delay caused by any act, error or omission of the airline, including their failure to deliver services, partial or inadequate delivery of services, airline policies including refund or rebooking policies, fees for checked or carry-on luggage, fuel increases, bankruptcy or cessation of operations.
  • Frequent Flyer mileage accrual is at the discretion of the airline(s). SS/The Suite Sojourn has no liability if accrual of miles or points is denied or if upgrades are not allowed. Many airlines do not permit upgrades on airfare purchased in certain fare classes or when using frequent flyer miles, loyalty status or certificates.
  • Seat assignments are not guaranteed even after they are assigned, and SS/The Suite Sojourn has no control over airline seat assignments. Most airlines charge a fee to pre book a seat.
  • SS/The Suite Sojourn shall not assume any responsibility for any air schedule changes. In rare instances, upon departure from a country, certain departure taxes must be paid in cash only, and may vary in price. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares. 

Airline e-tickets expire a year from issue date unless carrier fare rules in passenger’s itinerary fare provide otherwise.

Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. Reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights.
  • You understand and agree that SS/The Suite Sojourn functions solely and exclusively as a booking agent for the air carrier, that we do not handle or hold client funds for airline tickets, and that we are not the Merchant of Record under the meaning of that term under the Department of Transportation’s regulations. Because SS/The Suite Sojourn does not hold or handle client funds, you understand and agree that any refund for cancelled or delayed flights, baggage fees or seat assignments must come directly from the airline and not from SS/The Suite Sojourn.

 

PAYMENTS AND CANCELLATION

You shall be entirely responsible for all charges, fees, duties, taxes, and assessments arising from your travel bookings through The Suite Sojourn, LLC. By submitting a credit card to The Suite Sojourn, LLC, you agree to allow The Suite Sojourn, LLC to use your payment method to purchase travel products from our suppliers on your behalf. Excepting in cases of fraud, you agree not to file any dispute with your bank or credit card company to avoid or violate any booking terms and conditions of The Suite Sojourn, LLC or its suppliers, including cancellations or changes of itinerary or arrangements for reasons beyond the control of The Suite Sojourn, LLC or its suppliers. If you attempt to chargeback, reverse, or recollect a previously authorized trip payment, The Suite Sojourn, LLC reserves the right to collect all additional costs, fees, and expenses associated with such chargeback, reversal, or recollection, including, without limitation, attorney fees.

In certain cases, when paying by credit card, you may choose ability to dispute charges with credit card companies (“chargebacks”). Before initiating a chargeback, we ask you first email us at urvshi@thesuitesojourn.com to discuss any questions or concerns about the charge(s) in question. We will work with you in attempting to resolve your concerns. By using our service to make a reservation, you accept and agree to the cancellation policy. The Suite Sojourn, LLC retains the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback, in which case the cancellation charges as set out below would apply. The following chargeback scenarios are improper and we retain the right to investigate and rebut any such chargeback claims:

  • Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used.
  • Chargebacks resulting from force majeure or other circumstances that are beyond the control of The Suite Sojourn or the Suppliers.
  • Chargebacks resulting from charges authorized by family, friends, associates or other third parties with direct access to your credit card. This does not include credit card fraud.
  • Chargebacks arising from inconsistency or inaccuracy with regard to the supplier’s product description.
  • Chargebacks resulting because you do not agree with the cancellation policy.

 

Cancellations and Refunds

  • All payments for travel are due prior to departure according to each Supplier’s (air fare, hotel, cruise line, transfer company, sightseeing operators, and other travel service vendors) terms and conditions of booking. You understand that failure to make final payment or any violation of a Supplier’s conditions of purchase may result in cancellation of your reservations, in your being denied access to any tours, hotels, cruises, or other travel services, or in your forfeiting any monies/ deposits paid for your reservations.
  • The Suite Sojourn, where possible will request the suppliers for payment links / ACH payment information so the Traveler may pay the supplier directly.  In the event, payment links / ACH payment is not available, The Suite Sojourn maybe required to pay all suppliers in accordance with their own terms and conditions, some of which require payment from The Suite Sojourn LLC well in advance of your tour date. This includes but is not limited to hotel accommodations, meals, admission tickets, transportation, etc. All suppliers have their own cancellation policies, which apply to your booking(s). Should a cancellation become necessary, please inform The Suite Sojourn immediately in writing and request a written confirmation of your cancellation. Upon, receipt, The Suite Sojourn LLC will contact suppliers for any applicable refunds as outlined in the supplier’s terms and subject to their review. If you are entitled to a refund, please note that the supplier is responsible for this refund, not The Suite Sojourn. Suppliers may choose to provide a travel voucher or credit in lieu of refund.  We are not responsible for a supplier’s failure to pay a refund or for supplier bankruptcy or insolvency.
  • In some cases, there is NO REFUND once a booking is made and paid for under deposit. Your right to a refund if you change or cancel your travel plans is limited. You may not be entitled to a refund if you change or cancel your travel plans after confirmation of a booking. All cancellation requests must be sent to The Suite Sojourn, LLC in writing. As a result of cancellation, The Suite Sojourn, LLCs and third-party Supplier’s cancellation penalties will apply which are detailed in your travel documentation, this website, and each of the supplier’s website. Cancellation penalties are advised at the time of booking and provided to you upon confirmation. If you have any questions, or any penalties are unclear, please contact The Suite Sojourn, LLC in writing. All cancellation fees will be charged to the credit card or other payment method you authorized to pay for travel services, or deducted from the Supplier’s refund. When you receive any and all travel documents, it is your responsibility to review and verify all information for accuracy. Contact The Suite Sojourn, LLC immediately if changes or corrections are required.
  • By reading these terms and conditions, you agree to the above and in addition if you change your credit card number from the time of booking, prior to your travel, during your travel, or at any time due to a unrelated or a related dispute, or for any other reason, your reservations may be cancelled and if you do not inform The Suite Sojourn, LLC of this at your own accord, you agree to not hold The Suite Sojourn, LLC liable if this results in any change, or cancellation in its entirety or in part of any reservation(s), or booking(s) with any Supplier(s).
  • If the reason for cancellation is covered under the terms of your travel protection plan you may be able to reclaim these charges, for this reason we strongly encourage the purchase of a travel protection plan including additional cancel for any reason coverage.
  • Airline tickets are governed by the air carriers’ terms, and we are not responsible for any air carrier’s decision regarding refund.

Unauthorized Use of Cashback or Third-Party Booking Portals

To protect agency commissions and supplier relationships, travelers agree not to use cashback, rebate, or discount portals (including, but not limited to, Rakuten, Capital One Shopping, or similar platforms) when completing payments for reservations arranged by The Suite Sojourn, LLC and/or its host agency.

If a traveler uses any such portal, link, or third-party service in a manner that results in the loss, reduction, or redirection of agency commission, the traveler shall be financially responsible for 100% of the lost commission amount, in addition to an administrative inconvenience fee of $100 per person, per original night of booking, plus any related fees or penalties imposed by the host agency on The Suite Sojourn, LLC.

All such fees shall be due and payable within ten (10) business days of written notification. These fees are intended to cover administrative time, supplier disruption, and financial impact resulting from the unauthorized transaction.

NO REFUND FOR UNUSED ARRANGEMENTS

As The Suite Sojourn’s prices are based on contract rates, there will not be any refund for any unused portion of a travel booking. If you cancel while the trip is in progress, there is no refund for the unused portion. Rather, we reserve the right to charge  for lost commission as a result of your being a no-show, if applicable. 

IN THE EVENT OF NO- SHOW, WITH OR WITHOUT PRIOR COMMUNICATION

Any failure to check in for a confirmed reservation—whether or not prior communication is provided—constitutes a no-show. In such instances, you agree to be liable for 100% of the commission lost, which must be paid within 24 hours of the no-show coming to our notice. You authorize us to charge your credit card on file for the full amount. 

Please note that our charges are separate from, an in addition to, any fees or charges assessed by the hotel, tour operator, DMC, or any other party for which you were a no-show for. Furthermore, our host agency reserves the right to charge you separately from The Suite Sojourn for commission lost due to the use of their IATA credentials.

DESTINATIONS AND DOCUMENTATION

  • Travel to certain destinations may involve greater risk than others. The Suite Sojourn LLC urges Travelers to remain informed on a daily basis as to current news, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov, and http://www.cdc.gov. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/. In addition, you should consult with government websites to ensure that you are in compliance with all requirements for admittance into that country, including COVID- 19 requirements, as well as understanding local laws that govern travel within a country, such as medical tests and tracking. It is your responsibility to be aware of any and all requirements for admittance to a country or state, including Covid-19 requirements. Should you choose to travel to a country that has been issued a travel warning or advisory, The Suite Sojourn LLC will not be liable for damages or losses that result from travel to such destinations.
  •  It is the responsibility of each traveler to obtain and carry a valid passport, visa(s), inoculations, reciprocity fees, and all other documents required by applicable government regulations. For up to date requirements US citizens should visit www.travel.state.gov. When travelling domestically within the USA or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight, found here: http://www.tsa.gov/traveler-information/acceptable-ids. The Suite Sojourn LLC strongly recommends that you take into account that certain countries will not admit a passenger if their passport expires within six (6) months of the date of entry. Non-USA citizens may require additional documentation. Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities. In some countries entry may be subject to entry (reciprocity) fees and/or departure taxes/ exit fees which will be collected at the airports upon entry/departure by local government authorities.  Please note that entry to any country may be refused even if the required information and travel documents are complete.
  • Recommended inoculations for travel may change and you should consult your healthcare practitioner(s) for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip. Inoculation requirements can be found on the Center for Disease Control website at https://www.cdc.gov/.
  • You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing traveler to miss flight(s), and subsequent scheduled travel bookings tours.  The Suite Sojourn LLC bears no responsibility for advising and/or obtaining required travel documentation for you, or for any delays, damages, and/or losses including missed portions of your vacation related to improper documentation or government decisions about entry.

 

INDIVIDUAL ENTRY AND EXIT REQUIREMENTS

  • Each foreign country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or past offense, and you are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements. You can visit the US State Department Website for further information about these requirements (See: https://travel.state.gov/content/travel/en/international-travel/International-Travel-Country-Information-Pages.html) The Suite Sojourn, LLC neither controls nor warrants the issuance of visas related to applicable travel. It is Traveler’s responsibility to verify that all the visas required for your trip have been obtained, that the visas for each country are valid for the entry and exit dates of your visit, that your personal details are accurately reflected and that your passport is valid for at least six months beyond the completion date of your trip. Please note that even when a visa is issued, a traveler may be denied entry since each country’s local immigration officials make the final entry decision. Several factors including past criminal record may contribute to the decision of the local immigration official(s). Should a visa not be issued, The Suite Sojourn, LLC is not responsible for lost payments made toward the contemplated trip.  We feel it is an invasion of privacy for any member of our staff to make such an inquiry. For example, if traveling to or through Canada, individuals with a Driving While Intoxicated (DWI) record should always check whether current rules exclude admission, and potential waivers. ASSUMPTION OF RISKS/ SAFETY; COVENANT NOT TO SUE

  • By booking travel with The Suite Sojourn, LLC, you are agreeing to terms that will waive certain legal rights and agree not to sue. Traveler is aware that travel may involve hazardous activities, some in remote areas of the world. Inherent hazards and risks include, but are not limited to, risk of injury or death from: motor vehicles collisions, animals, roadway hazards, slips, and falls, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; Traveler’s own negligence and/or the negligence of others, including tour guides, other guests, The Suite Sojourn, LLC and its employees, agents and/or representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; fatigue, chill, overheating, and/or dizziness,; known or unknown medical conditions, physical excursion for which Traveler is not prepared or other such accidents; the negligence or lack of adequate training of any agents or employees of The Suite Sojourn, LLC or their third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided.
  • We may book wellness travel for clients, which may include yoga, meditation, medi-spa, and other activities, treatments and services intended to maintain, manage, or improve travelers’ health and well-being (“Activity” or “Activities”). We have no specialized knowledge of the practices or techniques employed by our Suppliers, and make no representations of the qualifications of the professionals and practitioners who offer these Activities. We make no representations that by participating in these Activities there will be any demonstrable improvement in your physical, mental, emotional, or spiritual well-being. We are not responsible if your participation in these activities leads to a worsening of any condition you may have. We are not responsible for any injuries you may sustain, illnesses you may contract, including injuries or illnesses that may result in loss of life. You acknowledge that you are voluntarily participating in the Activities on your itinerary, and that you understand that there are risks associated with your participation in the Activities, such as physical and/or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, death or economic loss. These injuries or outcomes may arise from your own or other’s actions, inactions, or negligence, or the condition of the Activity location(s) or facility(ies). Nonetheless, you assume all risks of your participation in the Activity, whether known or unknown to you, including travel to and from the Activity (including air travel) or any events incidental to the Activity.
  • Certain activities that are included as part of itineraries that we book pose inherent risks and may be dangerous. Your itinerary may also involve travel to remote areas without access to medical facilities or treatment; changing weather conditions; interactions or encounters with wildlife. By booking a trip with The Suite Sojourn, LLC, you acknowledge that you are aware that the physical exertion required to participate in certain activities can activate or aggravate pre-existing injuries, conditions, or congenital defects. You acknowledge that you should seek medical advice if you know or suspect that your physical condition may be incompatible with the activities on your itinerary. You may be required to wear approved safety equipment while participating in certain activities, and by booking travel with us and participating in these activities, you agree to use the recommended safety equipment and to ask questions if you are unsure about how to properly or safely use equipment. If you use, consume, or are under the influence of alcohol or illegal drugs prior to or while engaging in any activities on your itinerary, you assume and accept all risks, dangers, and hazards that may result from this, including the possibility of personal injury, death, property damage, and loss, even in the event of negligence or fault by The Suite Sojourn, LLC or third parties, and you indemnify The Suite Sojourn, LLC from any and all liability for any damage to property or personal injury to any third party, resulting from your participation in the activities, while, during, or after consumption of illegal drugs or alcohol.
  • By offering for sale travel to particular destinations, The Suite Sojourn, LLC does not represent or warrant that travel to such points is advisable or without risk, and shall not be liable for costs, damages, or losses that may result from travel to such destinations. Traveler’s participation constitutes acceptance of such events at Traveler’s own risk. Traveler understands the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death.  In order to partake of the enjoyment and excitement of any trip Traveler is willing to accept the risks and uncertainty involved as being an integral part of its adventure. Traveler hereby accepts and assumes full responsibility for any and all risks of illness, injury or death and of the negligence of The Suite Sojourn, LLC and agree to and shall hold harmless and fully release The Suite Sojourn, LLC from any and all claims associated with a trip, including any claims of third party negligence and Traveler/Participant hereby covenants not to sue The Suite Sojourn, LLC for any such claims or join any lawsuit or action that is suing The Suite Sojourn, LLC.

 

USE OF THE SUITE SOJOURN, LLC, ACCESS AND INFORMATION FOR TRAVEL BOOKINGS

  • You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and to make travel bookings with The Suite Sojourn, LLC by any means, including our website in accordance with all terms and conditions herein. You agree to be financially responsible for all of your travel bookings (as well as for use of your account by others, including, without limitation, minors living with you). You agree to supervise all usage of The Suite Sojourn, LLC communication by minors under your name or account. You also warrant that all information supplied by you or members of your household transacting business with The Suite Sojourn, LLC is true and accurate. Without limitation, any speculative, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited. You agree that the travel services reservations facilities provided by The Suite Sojourn, LLC shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act.
  • Traveler authorizes The Suite Sojourn, LLC to book on third party travel booking sites to fulfill Traveler’s travel requests. Traveler ratifies The Suite Sojourn’s actions on Traveler’s behalf, including acceptance of such third party’s terms and conditions, which limit Traveler’s rights, and Traveler agrees to bound by such actions. In the event of any inconsistency or ambiguity of terms, The Suite Sojourn, LLC shall benefit from the most favorable term(s) in each instance.

 

LATE BOOKINGS

  • Prospective Travelers are advised to reserve early to avoid disappointment, increases in fares, and additional late booking fees.

 

NO REFUND FOR UNUSED ARRANGEMENTS, MINIMUM PASSENGER REQUIREMENTS, AND ALTERATIONS TO CONFIRMED BOOKINGS

  • When trip, cruise, or package prices are based on Suppliers’ contract rates, you will not be entitled to any refund for any unused portion of travel. Some group trips are based on a minimum number of passengers traveling; if the number of passengers falls below the minimum required, a surcharge may be imposed, or the trip may be canceled. Any cancellations of a trip or package for reason of failing to meet the minimum traveler requirement will be governed by the tour operator’s cancellation policy. If you decide to change any portion of your confirmed arrangements prior to departure or during your trip, we will attempt to assist you at our applicable administrative charge, depending upon circumstances of the request. Certain bookings may not be able to be changed. All requests for changes to a booking must be made in writing to The Suite Sojourn, LLC. The Supplier may determine that alterations to an itinerary are necessary for any number of reasons, including but not limited to severe weather. Any alterations to an itinerary are at the sole discretion of the Supplier, and The Suite Sojourn, LLC bears no responsibility for any changes.

 

CURRENCY FLUCTUATIONS

  • Currency exchange rates fluctuate. Prices are subject to change based on currency exchange rate fluctuations, provided actual variations have occurred. The Suite Sojourn, LLC is not responsible for surcharges or foreign transaction fees imposed by Traveler’s credit card or bank.

 

IMPORTANT INFORMATION FOR DOMESTIC AIR TRAVELERS

  • The Federal Real ID Act mandates stricter security standards for state-issued driver’s licenses and other forms of identification and prohibits Federal agencies from accepting for official purposes identification that does not meet these standards. Beginning on October 1, 2021, every air traveler will need to present Real ID-compliant identification to be permitted to board a domestic flight; therefore, those holding a non-compliant driver’s license will need to present an acceptable alternate form of identification, such as a valid U.S. passport. To avoid disruption to their travel plans, air travelers are strongly encouraged to consult with the Department of Homeland Security (www.dhs.gov/real-id) to determine whether their state-issued identification is Real ID-compliant and, if not, what alternate forms of identification will be accepted at the airport.

 

HEALTH/SECURITY/TRAVEL DOCUMENTATION REQUIREMENTS

  • Each Traveler is responsible to make absolutely certain to have the proper immunizations and required documentation of such immunizations before travel, and to make the necessary accommodation for security rules imposed by government authorities. The Suite Sojourn, LLC shall not assume responsibility for the accuracy of health requirements or vaccination, and/or documentation prior to departure or upon landing at the final destination. See your health practitioner for advice. Prior to travel, required inoculations, if any, must be recorded by Traveler’s health practitioner on a valid vaccination certificate, which the Traveler must carry for proof of inoculation where required. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking. Check the USA State Department website for relevant information relating to travel to specific destinations, and the USA Centers for Disease Control relating to health issues related to travel.
  • For further information relating to security, safety issues, crime, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to your domestic and/or international destination(s), and re-entry into the United States , visit http://www.tsa.govhttp://www.dot.gov; https://www.faa.gov/; http://www.ustreas.gov; https://www.cbp.gov/ on a regular basis for information regarding incidence of disease, terrorism, safety issues, crime, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to your domestic and/or international destination(s), and re-entry into the United States especially your embassy and http://www.uscis.gov/ for non-USA citizens. (Traveler is responsible to make The Suite Sojourn, LLC aware when traveling on a passport from a country other than the USA).

 

HAZARDOUS MATERIALS

  • USA Federal law prohibits passengers from bringing hazardous materials on the aircraft. (1) Federal law forbids the carriage of hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. A violation can result in five years imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids, and solids, oxidizers, poisons, corrosives, and radioactive materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radiopharmaceuticals. (2) There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger’s luggage and certain smoking materials carried on the passenger’s person. For further information, each passenger should contact the relevant airline representative(s) on their itinerary. Restrictions on hazardous materials are listed here.

 

Pre-existing Medical Conditions/Persons with Disabilities.

  • The nature of many of the destinations we travel to means that in some cases they may be unsuitable for those who use a wheelchair or have a lack of mobility. However, we will be delighted to discuss the feasibility of your participation in any of our trips.
  • It is essential that you advise us before booking if you do have any disability or pre-existing medical condition which may affect your tour, or if you have any special requirements as a result of any disability or medical condition (including any which affect the booking process) so that we can assist you in considering the suitability of the arrangements and/or in making the booking. The Suite Sojourn LLC will communicate requests to Suppliers, but cannot be responsible if ADA accommodations are not available.  Any accommodations provided will be at the sole expense of the traveler requiring the accommodation. Please note that accommodations outside of the USA may not be in compliance with the Americans with Disabilities Act and may not have wheelchair accessibility.
  • Our Suppliers are, unfortunately, unable to offer additional assistance to travelers with limited mobility and all such assistance will need to be provided by whoever the traveler is traveling with. Travelers with disabilities must notify The Suite Sojourn LLC at the time of booking of status and of the identity of their non-discounted, paid travel companion who will be responsible for providing all necessary assistance. We may request that you provide a letter from your doctor confirming your fitness to travel.

 

HEALTH

  • For the safety or our guests, The Suite Sojourn reserves the right to request health information prior to travel and to exclude any participants it deems unfit for travel at its sole discretion.

  • E-tickets expire a year from issue date unless carrier fare rules in passenger’s itinerary fare provide otherwise.

 

Non-Responsibility

  • The Suite Sojourn LLC and its employees, shareholders, agents, and representatives use third party suppliers to arrange transportation, sightseeing, lodging, and all other services related to this tour. The Suite Sojourn LLC is an independent contractor and is not an employee, agent, or representative of any of these suppliers. The Suite Sojourn LLC does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel or restaurants, or any other entity that supplies services related to your tour. All suppliers are independent contractors, and are not agents or employees or representatives of The Suite Sojourn LLC. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each supplier, and by accepting the coupons, vouchers, and tickets, or utilizing the services, all travelers agree that neither The Suite Sojourn LLC, nor its employees, agents, or representatives are or may be liable for any loss, injury, or damage to any tour traveler or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of The Suite Sojourn LLC. The Suite Sojourn LLC assumes no responsibility or liability for any delay, change in schedule, loss, injury or damage or loss of any traveler that may result from any act or omission on the part of others; The Suite Sojourn LLC assumes no responsibility or liability for personal property; and The Suite Sojourn LLC shall be relieved of any obligations under these terms and conditions in the event of any strike, labor dispute, act of God, or of government, fire, war, whether declared or not, terrorism, insurrection, riot, theft, pilferage, epidemic, pandemic, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation. The Suite Sojourn LLC accepts no responsibility for lost or stolen items. The Suite Sojourn LLC reserves the right to refuse any traveler or potential traveler at its sole discretion.
  • Weather conditions, including but not limited to the presence or absence of snow, sunshine, and rainfall are not guaranteed to occur or not occur, and are clearly outside of The Suite Sojourn’s control. Volcanic eruptions, ash clouds, and wind may be characterized as an adverse weather condition or a natural disaster by suppliers and your travel insurance company, which is beyond the control of The Suite Sojourn. The Suite Sojourn reserves the right to cancel any itinerary or any part of it, to make such alterations in the itinerary as it deems necessary, and to refuse to accept or to retain as a member any person of any tour at any time. The Suite Sojourn shall not assume any responsibility for any air and/or ground schedule changes.
  • The Suite Sojourn, LLC has solely received commission and fees for travel transactions and Traveler agrees and understands that any recovery from The Suite Sojourn, LLC will be limited to the commission and fees paid by Traveler and actually received by The Suite Sojourn, LLC in the past 3 months prior to the action giving rise to the liability.

 

FORCE MAJEURE

  • The Suite Sojourn, LLC, assumes no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire or accident, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities including loss of internet, or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by The Suite Sojourn, LLC that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. The Suite Sojourn, LLC shall not be deemed to be in breach of these Terms and Conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure.
  • If The Suite Sojourn, LLC and/or any of its travel suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to your trip. In the circumstances amounting to force majeure, we will not be required to refund any money to you, although if we can recover any monies from our suppliers, we will refund these to you without any charge by The Suite Sojourn LLC. The original non-refundable deposit will not be returned as it accounts for the work we did in planning your tour. Regarding civil unrest, once The Suite Sojourn, LLC has investigated the prevailing situation, as it deems fit, it shall remain in The Suite Sojourn, LLC’s sole and absolute discretion whether to proceed with your trip. You may in such circumstances cancel the trip subject to The Suite Sojourn, LLC and each supplier’s terms and conditions.

 

Travel Protection

  • The Suite Sojourn, LLC offers access to travel insurance. It is the traveler’s responsibility to protect their purchases. The purchase of travel insurance is not required in order to purchase any other product or service offered by The Suite Sojourn, LLC, however, if you decline to purchase insurance on your own, or do not respond when prompted to purchase insurance, you will considered to have waived the purchase of travel insurance. Travel Protection Plans including cancel for any reason coverage must be purchased in close conjunction with your travel purchase. Travel Protection Coverage including additional cancel for any reason coverage is strongly recommended. Such plan should cover Trip Cancellation or Interruption, Medical Expense, Emergency Evacuation/Repatriation, and Baggage. Travel protection plans can help protect you in the event of loss of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a covered reason such as injury or illness before or during the trip). It also helps with reimbursement for medical emergency costs (including very costly medical evacuation costs), missed connections and baggage loss.
  • The Suite Sojourn LLC is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel insurance plans. The Suite Sojourn LLC cannot evaluate the adequacy of the prospective insured’s existing insurance coverage. The Suite Sojourn, LLC cannot guarantee that any insurance provider will approve coverage for a claim made under the insurer’s policy and makes no representations about the extent of coverage for any policy it may offer or quote. If you have any questions about your travel protection, call your insurer or insurance agent or broker.
  • Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. The Suite Sojourn LLC cannot be held responsible for denied entry if a traveler is unable to provide details to authorities of insurance or denial of entry for any reason. Declining to purchase an adequate travel protection plan could result in the loss of your travel cost and/or require more money to correct the situation. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without adequate coverage, SS/The Suite Sojourn will not be liable for any of your losses howsoever arising, for which trip protection plan coverage would otherwise have been available.

 

TRAVELER CONDUCT 

  • When you book with The Suite Sojourn, LLC, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid directly at the time to the accommodation owner or manager or other Supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us. We are not responsible for any costs incurred concerning a Traveler removed from a trip, or any portion of a trip. You agree not to hold The Suite Sojourn, LLC or any of its related entities liable for any actions taken under these terms and conditions. Baggage and personal effects are at all times the sole responsibility of the Traveler. Each Traveler in any trip escorted by The Suite Sojourn, LLC is expected to act responsibly and adhere to all behavior guidelines established by The Suite Sojourn, LLC and our Suppliers. In the sole discretion of The Suite Sojourn and our Suppliers,  The Suite Sojourn, LLC may remove you from any facility, hotel or resort property, tour location or means of transportation if your health or your conduct appears to endanger yourself or others, disrupts the general well-being of other Travelers on any element of your trip, or interferes with the operation or security, safety, comfort and enjoyment of the places we visit. In the event a Traveler is removed, such Traveler may be left at any city without any liability to The Suite Sojourn LLC or its representatives or Suppliers. The Suite Sojourn LLC shall not be required to refund any portion of the price paid by any traveler who is removed under the terms of this paragraph, nor shall The Suite Sojourn LLC be responsible for expenses for lodging, medical care, meals, transportation, or any other expenses incurred by the traveler.

 

ALTERATIONS IN TRAVEL PLANS

  • Alterations in the publish itinerary may be necessitated for any number of reasons. including but not. If a property, supplier, activity, or area is deleted for any reason, it may be replaced with a comparable or similar experience.
  • While no changes are anticipated, there may be occasions when certain alterations become necessary.  These can be due to religious holidays, national celebrations, or unforeseen events including weather, tide schedules, governmental closures, acts of God, or any other reason. The Suite Sojourn reserves the right to change the itinerary due to such unforeseen circumstances or emergencies. Additionally, historic sites undergo renovations from time to time which can obscure viewing or otherwise change the nature of visiting these sites.  No trips will be cancelled due to renovations, although The Suite Sojourn may choose to amend itineraries for such sites.   These changes will not be considered a material change and will not be considered cause for cancellation by the Traveler.
  • If we suggest alternate activities in place of a planned stop or in case of leisure time, such suggestions do not constitute our endorsement.  In such a case you will be subject to the terms and conditions of the supplier of the activity and your only recourse in case of damage will be against the supplier of the alternate activity.

 

PRICE AND RATE CHANGES

  • The price of your itinerary will be based on known costs at the date of issue of the itinerary.  All prices we advertise are accurate at the date published, but we reserve the right to change any of those prices from time to time.   Prices include a cost for local taxes that are estimated at the date of publication.  At the time of booking confirmation, we will provide you with an invoice reflecting the current price.
  • We reserve the right to add a supplement to your travel prices should our costs of supplying your travel increase, until we receive your final payment.  Any increase to your travel price will be as the result of changes in our costs of supplying your travel resulting from changes by our suppliers, dues or taxes payable locally, currency fluctuations and government action. If our costs to supply your travel increases, we reserve the right to increase the price of your travel and will forward a new Invoice reflecting any changes made after final payment your price is locked in.
  • We reserve the right to make changes to and correct errors in advertised prices at any time before your travel is confirmed.  We will advise you of any errors of which we are aware and of the then applicable price at the time of booking.
  • The Suite Sojourn, LLC reserves the right to correct errors, and offers are subject to availability. All offers, incentives, and Supplier promotions are subject to availability and may change without notice. In the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.

 

PHOTOGRAPHS/VIDEOS

  • The Suite Sojourn, LLC reserves the right to use any photograph/video taken at any event or during any travel activity, without the express written permission of those included within the photograph/video. The Suite Sojourn, LLC may use the photograph/video in publications or other media material produced, used or contracted by The Suite Sojourn, LLC including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, etc. Any person desiring not to have his/her photo taken or distributed must contact urvshi@thesuitesojourn.com in writing of his/her intentions and include a photograph. Each Traveler releases The Suite Sojourn LLC and its representatives from any liability in connection with any use of such photographs and/or video.

 

NO COPYING OR EDITING

  • No material may be modified, copied, reproduced, republished, downloaded, posted, displayed, transmitted, performed, licensed, used to make a derivative work, transferred, sold or distributed in any way, without The Suite Sojourn’s prior written consent. You may not frame or mirror any material on this website on any other server or other location. Unauthorized use of any such material on any other website or computer environment or elsewhere is strictly prohibited.

 

ACCESS TO PASSWORD PROTECTED/SECURED AREAS

  • Access to and use of password protected and/or secure areas of this website is restricted to authorized users only. Unauthorized individuals attempting to access these areas of this website may be subject to legal prosecution.

 

E-MAIL UPDATES

BY ACCEPTING THIS AGREEMENT, YOU WAIVE AND HOLD HARMLESS THE SUITE SOJOURN, LLC FROM ANY AND ALL CLAIMS RESULTING FROM ANY ACTION TAKEN BY THE SUITE SOJOURN, LLC DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER THE SUITE SOJOURN OR LAW ENFORCEMENT AUTHORITIES.
  • You hereby certify that you are at least 18 years old. If you are under 18, please do not use http://thesuitesojourn.com/ or any of our other services. We do not knowingly collect any personally identifiable information from any person under 18 years old.

 

Indemnification

  • Traveler agrees to and shall indemnify and hold harmless The Suite Sojourn and its owners, employees, agents, and assigns (collectively “The Suite Sojourn”), from any expenses, losses, liabilities, damages, judgments, settlements and costs (collectively, “damages”) involved with or incurred by  The Suite Sojourn (including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to any claims, law suits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) traveler’s breach or violation, or threatened breach or violation, of this Agreement and (ii) Any damage caused by traveler while participating in the trip.

 

Baggage Fees

  • Due to continual changes in airline baggage policies, it is suggested that you inquire with your airline’s website for up-to-date fees & information. The Suite Sojourn is NOT responsible for additional fees incurred for baggage or seating.

 

Re-Confirm Your Flight

  • The Suite Sojourn advises you personally to re-confirm your flight schedule within 24 hours prior to departure directly with the airline in case of any last-minute changes or delays. Most airlines allow you to check in online 24 hours prior to departure.

 

CHOICE OF LAW/VENUE/CLASS ACTION WAIVER/LIMITATION of DAMAGES/Notice of Claim

  • This Agreement and all attachments hereto and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of New Jersey exclusive of conflict or choice of law rules. Any claims shall be brought in a court of competent jurisdiction located in New Jersey. You agree that you will only bring claims against The Suite Sojourn LLC in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding. The Suite Sojourn LLC shall not in any case be liable for other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit against The Suite Sojourn unless you have first provided a typewritten notice of claim to The Suite Sojourn within 30 days after the trip or cancellation of the trip.

KNOWING AND VOLUNTARY EXECUTION

Traveler has carefully read this Agreement, and fully understands its contents. Traveler(s) is/are aware that this is a release of liability and a contract between them and The Suite Sojourn, LLC and/or its affiliated organizations and Traveler knowingly agrees to it of their own free will, without duress.
